if you check the most up to date chart though D3 have actually fallen pretty deep...

i mean they r still selling within top 10 i think and that's pretty good, but they've fallen pretty rapidly over the week... so i wouldn't dismiss the effect of their less than stellar online system on their sale quite so readily.

I'm fairly strong on issues of gamer entitlement, in this case though if the game is inaccessible and not offering reasonable service as described, Blizzard might be having a tonne of bad PR to deal with. If it's because they couldn't log in because of maintenance (yeah stupid to have that for the singleplayer experience regardless imo) then Blizzard usually give fair notice of it occurring (but not always).

just having a quick read through of the d3 license and there seems to be a glaring error in section 18 where it refers to 15(d) and there is no 15(d) just a 16(d).
with such an error does that negate just section 18 or the whole license ?

As many have already stated, this statement is worth practically nothing in realistic teams and that would apply to most countries, but epically Australia. It's inserted for the sole reason of deterring people who are ignorant of their rights from applying for a refund.

I find it ridiculous for people to think that these Eula's (this clause especially) could be worth anything when you have to accept it BEFORE you can even log into the game to see if it is working as designed / promised.

Mate, I'm not worked up - and I wasn't having a go at you. Just pointing out how stupid the EULA is and the main reason for it being there, that's all.

It needs to happen. I am sick of big companies hiding behind "contracts" as the defense for poor service.

It seems if this sort of thing happens to any other company then blizzard also they seem to get smashed, but with blizzard they seem to have everyone leaping to their defense.

Too many Blizzard fanboys blind to faults. I've also tried to convince people that what Blizzard has done isn't in the player's best interests but they seem to jump to their defence by providing weak (IMO) excuses for what Blizzard has done.

Not worth the time arguing with these people.

For what it's worth, I'd actually like to see all game companies investigated for this sort of thing - most notably EA.

That's not applicable here in Australia. Consumer law trumps any EULA - you can't sign away your right to a refund if the product does not work as advertised.

Seems like a fairly contestable EULA no matter what the country. How on earth can a merchant protect themselves by saying "no matter how broken, if you buy it it's yours?"

Still, more and more keen to play D3 by the day, just need to figure out which of my dwindling stash of games I can trade in to buy it.

Regardless of its list of "issues", I think most of us playing it love it to bits! Half the frustration is because it's just so damn good when it bloody wants to work hahaha :D

Please do let me know just where in the game launcher or game proper does any message regarding expected server maintenance downtime's appear, as i have seen no such thing at any point.

In fact on the many occasions where i have had problems signing in (and later found out that server maintenance had been in progress) there was no indication that my login was failing because of this, just a variety of error codes and unclear messages.
