Fallout MMOG license in jeopardy

Interplay, your license is about to expire!
Interplay faces possible legal challenge from Bethesda over the Fallout MMOG license. No formal legal action is yet pending, but in a recent SEC filing Bethesda believes Interplay is "in breach of the trademark license agreement." Under certain preconditions Interplay retained the rights to develop a MMOG based on the Fallout universe. The inked deal took place back in 2007 when Interplay sold the post-apocalyptic property at the dirt-cheap price of US$5.75 million.

According to the agreement, if full scale development on the project and if the budget for the project wasn't up to a certain standard by April 4, 2009 Interplay would be in breach of their agreement and forfeit all rights. Interplay disagrees with Bethesda's assessment.

“Interplay adamantly disputes these claims. Although the potential damages are currently unknown, if Bethesda ultimately prevails and cancels the trademark license agreement, Interplay would lose its license back of the Fallout MMOG and any damages resulting therefrom are unknown at this time.”

A few days ago, Interplay announced a partnership with Earthrise developer Masthead Studios to co-fund and co-develop Project V:13. The rumored code name for the Fallout MMOG. A last ditch effort to retain rights? This doesn't bode well for the ever-struggling Interplay.
